Repossessed Aircraft Bidding

CFC must occasionally liquidate repossessed inventory. CFC liquidates such aircraft pursuant to applicable state and federal law, including, without limitation, the Uniform Commercial Code. The following conditions apply only to repossessed aircraft contained on CFC's bid list.

1. Bidding. All aircraft are subject to prior sale or withdrawal from the market without notice. By submitting a bid, you are making a legally binding and irrevocable offer to purchase the aircraft at the price of your bid. If CFC accepts your bid, you are legally obligated to complete the transaction. Your failure to complete the transaction is a breach of contract, is legally actionable by CFC, and may disqualify you from future bidding. All bids must submitted in writing and be signed by an individual that is authorized to enter into contracts on behalf of the bidder. A facsimile signature shall be treated as an original signature for all purposes. Bids must be received at CFC's Wichita, Kansas, office by the bid deadline in order to be considered by CFC. All bids are in U.S. dollars and are subject to these Bidding Procedures which are subject to change at any time. All sales are final.
2. Bid Acceptance. All aircraft is subject to prior sale or withdrawal from the market without notice. CFC reserves the right to reject any and all bids and to bid itself. The winning bidder will be notified promptly after the bidding period ends. Financial arrangements satisfactory to CFC for the purchase of the aircraft must be provided for within forty-eight (48) hours of notification or CFC may void the bid and either accept the next best bid or re-open the bidding on the aircraft.
3. Sales & Use Taxes. Applicable sales and use taxes are the responsibility of the buyer and will be added to the purchase price unless CFC is furnished with an applicable tax exemption certificate.
4. Disclaimer. Aircraft specifications and log books are subject to customer verification and do not constitute representations or warranties of CFC. The buyer is responsible for the costs of all inspections and related due diligence whether or not any sale actually occurs. CFC is not responsible for storage or storage costs after closing. All aircraft are sold on an AS IS, WHERE IS basis. CFC IS NOT THE MANUFACTURER OR AGENT OF THE MANUFACTURER OF ANY AIRCRAFT. CFC MAKES NO WARRANTIES OR REPRESENTATIONS WHATSOEVER CONCERNING THE AIRCRAFT, EXPRESS OR IMPLIED, WHETHER OF TITLE, AIRWORTHINESS, MERCHANTABILITY, CONDITION, DESCRIPTION, DURABILITY, FITNESS OR SUITABILITY FOR ANY PARTICULAR USE OR PURPOSE, COURSE OF DEALING, OR TRADE USAGE. CFC, EXCEPT WHERE PROHIBITED BY APPLICABLE LAW, HEREBY DISCLAIMS ALL SUCH WARRANTIES. IN NO EVENT SHALL CFC BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE WEB SITE, THE BIDDING PROCESS, OR YOUR PURCHASE OF THE AIRCRAFT.
5. Escrow. CFC will act as escrow agent for all transaction unless CFC, at its discretion, chooses to use a third party escrow company. The expense of a third party escrow company shall be paid by the buyer.
6. International Sales. In addition to the Terms and Conditions set forth above, CFC's acceptance of any bid from a bidder located outside of the United States is subject to the final execution of a contract acceptable in form and substance to CFC and its counsel.

Privacy Policy

Your privacy is important to CFC. We understand the concerns about the use of information and data collected on our visitors' Internet use as well as credit application information. Please review CFC's Internet Privacy Policy and Federal Financial Privacy Law Disclosure . There is no need for you to tell CFC not to collect personal identifiable information regarding your Internet use because CFC does not use cookies or collect such information from your web browser.
